Magdalena Danielová 19. 6. 2023 Abstract Lease of the Business Premises The aim of the thesis is to analyse the legal regulation of a lease of the business premises, as it is currently contained in the Act No. 89/2012 Coll., the Civil Code (Civil Code). With the date of effectiveness of the Civil Code on 1 January 2014 numerous amendments were introduced in the area of a business lease. The previous legal regulation was contained in particular in the Act No.116/1990 Coll., on the lease and sublease of non-residential premises, as a special legal regulation to the Act No. 40/1964 Coll., the Civil Code. With regard to the transitional provisions of the Civil Code which regulate the application of its provisions on a lease of non-residential premises established before the effectiveness of the Civil Code, the thesis also includes the comparison of the both mentioned regulations. The thesis is divided into seven chapters. Lease of the Business Premises The aim of the thesis is to analyse the legal regulation of a lease of the business premises, as it is currently contained in the Act No. 89/2012 Coll., the Civil Code (Civil Code). Legal regulation of lease of apartments and the business premises

This diploma thesis deals with a legal regulation of lease of apartments and the business premises after the recodification of private law. I have divided the thesis into four chapters in which I try to provide a comprehensive view on the legal legislation. I refer to fundamental changes that were connected with the recodification of lease relationship and I also compare this with the previous legal regulation, an Act of 26 February 1964 the Civil Code, and it's subsequent amendments. In this part I also evaluete it's impact on rights and obligations of contractual parties. In the new legislation the legislator paid attention to the legal framework of the lease of an apartment, especially to the lease on business premises. The most significant difference between the lease of an apartment and the lease on business premises is in it's purpose. The purpose of a lease of apartment is, particulary, to ensure housing for a lessee and his household member, however the purpose of a lease on business premises is to satisfy business aims and aims of other persons who are lessee of these premises. In the case that the main purpose of the lease is not housing or the lessee is a legal entity then we have to use general provisions about the lease (e.g. Article 2201 and follows of the Civil Code). The subject of the master thesis is the legal regulation of lease of business premises after the effectivity of Act No. 89/2012 Coll., the civil code. The author disserts on the subject of the thesis in eight chapters, dealing with the basic juridical institutes taken over from the previous legal regulation, as well as the newly introduced juridical institutes. In the first chapter, the author defines basic institutes of a lease as a basic juridical institute. Following up, the thesis defines the lease of a business premises; the author aims on the terminology averted from the previous socialistic terminology. The author disserts on the new approach to the business premises. A special chapter is dedicated to capability of movable things to be a subject of a lease of business premises. The second chapter deals with the commencement of a lease of business premises, specifies the subject of a lease agreement, the lease term, rent. Above the scope of a legal regulation, the author contemplates on special variants of a rent payment. This thesis aims to analyse the applicable legal regulation of lease of commercial premises pursuant to the Act no. 89/2012 Coll., Civil code, as amended, in the context of general practice and with focus on material improvements of leased property. This thesis is divided into 11 chapters, each dealing with different aspects of the examined legal institute. The first two chapters are introductory and pertain to lease in general. The first chapter focuses on the evolution of lease throughout history, spanning from roman law to modern legal codes. The second chapter characterises lease as an obligation in general as it reports on placement of the relevant provisions within the civil code and on the characteristics of lease, which include its subject, yielding it to another for use, its temporariness and consideration. The third chapter deals with the subject of the lease, i.e. commercial premises and their administration in cases of co-ownership and community property of spouses.
